The 2026 year does not introduce a brand-new Form I-9, but it does introduce critical electronic system deadlines, form expiration risks, and heightened enforcement exposure for employers. Using the wrong I-9 version—even unintentionally—or failing to meet DHS electronic system requirements can result in significant fines, penalties, and audit findings.
Employers currently using the Form I-9 (08/01/23 edition), which expires July 31, 2026, must ensure their systems are updated to use the version expiring May 31, 2027 by the July 31, 2026 deadline. The updated form (01/20/25 edition) also carries the 05/31/2027 expiration date and includes minor but important language updates, including changes to document descriptions and an updated privacy notice.
Many employers are unaware that administrative changes effective January 1, 2025 are already required to be part of their I-9 process. Combined with electronic system requirements, these rules make I-9 compliance confusing—and costly when done incorrectly.

Form I-9 is often misunderstood as a simple fillable document—but it is not an electronic I-9 system under DHS standards. Employers using the fillable Form I-9 must still print and manually sign the form, as it does not meet DHS requirements for electronic generation, storage, and retention under 8 CFR § 274a.2.
Failure to meet DHS standards—especially when using electronic systems—can result in substantial fines, penalties, and audit exposure, even when errors are unintentional. If Form I-9 were truly simple, it would not require eight pages of instructions and a 60+ page manual to properly complete a one- to two-page form.
